    These terms and conditions apply to all services provided by Moxxs, an online marketing and communications agency. By using our services, you agree to the terms below. We recommend reading them carefully.

    1. Definitions

    • Client: the individual or legal entity entering into an agreement with Moxxs.
    • Agreement: any arrangement between Moxxs and the client regarding the provision of services.
    • Services: all marketing and communication services provided by Moxxs, including but not limited to strategic advice, content creation, social media management, design, and web
    • Content: all data, information, designs, texts, images, and other materials provided by the client to Moxxs.

    2. Applicability

    These terms and conditions apply to all offers, quotes, orders, agreements, and deliveries of services by Moxxs, unless otherwise agreed in writing.

    3. Quotes and Formation of Agreement

    • Quotes from Moxxs are non-binding and valid for 30 days unless stated otherwise.
    • An agreement is formed once the client has agreed in writing or electronically to the quote or offer.

    4. Services and Delivery

    • Delivery Time: Moxxs strives to provide an initial version within 48 hours of order confirmation for products where this timeframe is specified. Each request is evaluated individually to ensure this timeline is feasible. If the agreed timelines cannot be met, Moxxs will contact the client as soon as possible to discuss alternative delivery times.
    • Required Information: The client must provide all necessary information and materials on time to enable Moxxs to perform the services. Delays caused by failure to provide information or materials on time will be the client’s responsibility.
    • Collaboration with Third Parties: Moxxs may use third parties, such as designers and web developers via platforms like Upwork, to deliver its services. These parties operate under the responsibility of Moxxs.

    5. Liability

    • Moxxs is not liable for any direct or indirect damages unless these result from intentional misconduct or gross negligence by Moxxs.
    • Moxxs’s liability is always limited to the amount charged for the service or project concerned, with a maximum of the amount paid out by Moxxs’s insurer in the relevant case.

    6. Intellectual Property

    • All intellectual property rights to materials developed by Moxxs remain the property of Moxxs unless otherwise agreed.
    • Upon full payment, the client receives a non-exclusive, non-transferable license to use the delivered materials for the agreed purpose.

    7. Payments

    • The client must settle Moxxs’s invoices within 14 days of the invoice date.
    • In case of late payment, Moxxs reserves the right to suspend the provision of services.

    8. Confidentiality and Privacy

    • Both parties are obligated to maintain the confidentiality of all confidential information obtained within the framework of the agreement.
    • Refer to our Privacy Statement for more information on the processing of personal data.

    9. Use of Shared Content

    • The client retains ownership of the content provided to Moxxs.
    • Moxxs will only share content with third parties involved in executing the project.

    10. Termination and Cancellation

    • The client may terminate an agreement early with a notice period of at least one month.
    • If the agreement is terminated, the client must compensate Moxxs for services already rendered and costs incurred.

    11. Changes to the Terms and Conditions

    • Moxxs reserves the right to amend these terms and conditions.

    12. Governing Law and Disputes

    • All agreements between Moxxs and the client are governed by Dutch law.
    • Disputes will be submitted to the competent court in the district where Moxxs is established.
